These Terms of Use (“Terms”) govern your access to and use of Optimized Health’s websites, landing pages, advertisements (including Facebook/Instagram lead forms), SMS, and services (“Services”). By using the Services, you agree to these Terms.

1) Not Medical Advice

Content on our sites and ads is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Use of our website or lead forms does not create a patient–provider relationship.

2) Eligibility & Location

You must be at least 18 years old (or the age of majority in your state) to use our marketing sites and request services. We primarily serve patients located in the United States and within states where our clinicians are licensed.

3) Accounts, Scheduling & Cancellations

  • Appointments may be scheduled through our website, phone/text at (417) 707-1150, or via our patient portal (Optimantra).
  • Please provide accurate information. You are responsible for keeping your contact details current.
  • Missed or late-cancelled appointments may incur a $50 fee per our clinic policy (24 hour cancellation notice required).

4) Payments, Promotions & Refunds

  • Prices, packages, and promotions (including laser hair removal offers) are subject to change and may have eligibility limits, expirations, and exclusions.
  • Unless stated otherwise, fees are due at time of service. Certain services may be cash-pay and not billable to insurance.
  • Refunds are handled in accordance with our clinic policy and applicable law.

5) HIPAA & Privacy

Do not include protected health information (PHI) in general website forms or social lead ads. PHI is handled within our patient portal/EHR (Optimantra) under HIPAA. See our Privacy Policy for details on data collection, cookies, ads, and SMS.

6) User Conduct

You agree not to misuse the Services, interfere with their operation, attempt unauthorized access, or upload unlawful, misleading, or harmful content.

7) Intellectual Property

All content, trademarks, and materials on the Services are owned by or licensed to Optimized Health and may not be copied, modified, or distributed without permission.

8) Third-Party Services

Our Services may link to or integrate with third parties (e.g., GoHighLevel for communications/CRM, Optimantra for the patient portal, Meta for advertising). We are not responsible for third-party sites or practices.

9) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIMIZED HEALTH AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

11) Indemnification

You agree to indemnify and hold harmless Optimized Health and its personnel from any claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.

12) Governing Law & Disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflicts of law. Disputes will be resolved in the state or federal courts located in Missouri, unless otherwise required by law. You consent to their jurisdiction and venue.

13) Changes to the Services or Terms

We may update the Services and these Terms at any time. The Effective date above reflects the latest version. Continued use constitutes acceptance of changes.
